Booking
The sending of the on-line booking form confirms your acceptance of the terms and conditions set out below and shall be binding on all persons stated on the booking form.
Payment
Sunny Palms Resort House will be considered “reserved” once a 50 percent reservation deposit and credit card is provided to landlord. This can be received via check or credit card (Visa, Debit, MC or Discover) charged for at least 50 percent of total rental amount due. Balance is due 30 days prior to check-in date. A security deposit is required by providing a credit card, which will only be charged in the event the tenant does not return premises in a clean and good condition, or a check in the amount of $500, which is held and returned if premises are returned in good and clean condition. Please make all checks payable to Glen Mort.
Pets
NO PETS of any kind are allowed on or in the leased premises at ANYTIME. Should any pets be found on the premises by Landlord or his agents (property management company), it will constitute an immediate breach of this contract and will require immediate vacating of the premises without any refund. Additional payment may be required and charged to credit card if property is found to have damage as a result of any pets on the premises.
Occupancy
The maximum number of persons, including children of any age, is limited to eight (8). Any number of persons above 8 in the premises will constitute an immediate breach of contract and will require immediate vacating of the premises without any refund.
Minors
Tenant affirms that he/she is an adult (at least 21 years of age), and the property will not be occupied by minors unless an adult is present
Care
Tenant agrees to return premises to landlord, on expiration of this lease, in a clean and good condition as reasonable use will permit and to repair, replace or pay for any breakage or damage to the property, furnishings and equipment. Tenant is only responsible for breakage or damage done by tenant and/or his/her guests.
Additions
No fixtures, appliances, or air conditioning shall be installed without written consent by the landlord.
Visitations
The landlord and/or his agents, shall have access to the premises during the daylight hours to make repairs or to show the house for sale or rent. The landlord and/or his agents shall have access to the premises after daylight hours for any emergency. Tenant understands that property management services; lawn care, pool care, pest control, etc., will have access to grounds and premises on an as needed basis to keep premises in good and clean condition.
Repairs
Appliances, air conditioning, and amenities are not guaranteed and refunds will not be given due to breakdown. Repairs will be made as soon as possible and tenant will give access to property management contractors to make any required repairs.
Amenities
Landlord shall furnish blankets, linens and towels for up to eight (8) persons and for 1 King Bed, 1 Queen Bed and 2 Twin/Single beds and 1 pullout sofa sleeper, as needed.
Rentability
If said premises is destroyed by an act of God, so as to be unfit for occupancy, either prior to or during the term of the lease, the landlord shall return an equitable prorated share of any rents that may have been paid in advance. The lease shall not terminate as a result of cosmetic defects or inoperable non-essential appliances, including pool equipment.
Subletting
The tenant shall not sublet the premises without written consent by the landlord.
Default
Any default by the tenant under the terms and conditions of this lease, including but not limited to unpaid rent, shall result in the termination of this lease and the premises must be vacated immediately with no refund to the tenant.
Cancellation
All requests by the tenant to cancel this lease must be in writing to Glen Mort, and are subject to the property re-renting or acceptance by the landlord. Prior to 30 days of check-in date, all deposit monies will be refunded, minus a $25 administration fee. If 30 days or less prior to check-in date, deposit monies will be retained until property is re-rented, then all deposit monies will be returned, minus a $25 administration fee. If not re-rented, deposit monies will not be returned, but balance of rental monies is not due to landlord. Tenant agrees all deposit monies and rental monies will be held by landlord.
Acceptance
This lease must be signed and returned with a deposit within seven (7) days of the above date. Reservations cannot be guaranteed until deposit is received and lease is fully executed. This agreement is subject to the approval and acceptance of the landlord.
Counterparts
This contract may be executed in any number of counterparts, including counterparts transmitted by telecopier of FAX, and one of which shall constitute an original of this contract. When counterparts or facsimile copies have been executed by all parties, they all have the same effect as if the signatures to each counterpart or copy were upon the same document. Copies shall be deemed valid as originals.
Smoking
IS NOT PERMITTED in or on the premises. Smoking anywhere on or in the property, including, but not limited to, the screened-in pool area, will constitute an immediate breach of this contract and require immediate vacating of the premises, loss of all deposit monies and rental monies, and if deemed needed, additional security deposit monies will be charged to credit card to clean premises of all smoke-related issues.
Weather
The landlord can NOT guarantee the weather and will not refund any monies due to weather conditions.
Notice
Glen Mort is a licensed New Jersey real estate salesperson.
